Atos infracionais: disposições gerais à luz do Estatuto da Criança e do Adolescente e procedimentos na cidade de Espinosa, Minas Gerais

Resumo
Objetivo: Elucidar o tema da criança e do adolescente autores de ato infracional e a aplicação de medidas previstas no ordenamento jurídico brasileiro à luz das disposições gerais do Estatuto da Criança e do Adolescente – Lei 8.069/90 – bem como a garantia de direitos e a proteção integral, na perspectiva de oportunizar a inserção do menor de idade no convívio social, e tomar conhecimento do índice de atos infracionais praticados em Espinosa-MG.
Métodos: Para a efetivação do presente estudo, foram realizadas as pesquisas de campo quantitativa, bibliográfica e descritiva, com vistas a garantir uma melhor compreensão sobre tal problemática.
Resultados: Ato infracional é a conduta análoga ao crime, cometida por menores de 18 anos. Aplica-se aos menores de 12 anos apenas medidas protetivas e, entre 12 e 18 anos incompletos, medidas protetivas e socioeducativas. Nessa esteira, o levantamento de dados, mostra um decréscimo na quantidade de atos infracionais praticados em Espinosa – MG entre 2015 e 2017.
Conclusão: Embora crianças e adolescentes possuam direitos iguais, seus deveres se divergem quanto ao cumprimento de medidas aplicáveis no processo de ressocialização. O ECA, portanto, é uma instituição norteadora e reguladora das máximas das ações, ele regulamenta o seu cumprimento para o bom andamento da sociedade bem como a proteção da criança e do adolescente.

Abstract
Objective: To elucidate the subject of the child and the adolescent authors of infraction and the application of measures provided in the Brazilian legal system in light of the general provisions of the Child and Adolescent Statute - Law 8.069 / 90 - as well as the guarantee of rights and full protection, with a perspective to opportunizing the insertion of the minor in the social life, and to know the index of infractions committed in Espinosa-MG.
Methods: For the effectiveness of the present study, the quantitative, bibliographic and descriptive field researches were carried out, in order to guarantee a better understanding of this problem.
Results: Infraction act is the conduct similar to the crime, committed by minors under 18 years of age. Protective measures are applied to children under 12 years of age and, between 12 and 18 years incomplete, protective and socio-educational measures. In this wake, data collection shows a decrease in the number of infractions committed in Espinosa - MG between 2015 and 2017.
Conclusion: Although children and adolescents have equal rights, their duties diverge regarding compliance with applicable measures in the re-socialization process. The ECA, therefore, is a guiding institution and regulator of the actions maxims it regulates its fulfillment for the good progress of the society as well as the protection of the child and the adolescent.
